By visiting the website or using the services, the user accepts these Terms and Conditions.

No user registration will be required to access the website. However, to contract any of the services offered by Siempre Original, user registration and acceptance of these conditions will be required before formalizing payment.

Through the website, Siempre Original offers users clothing and accessories.

To purchase the products offered, the User must register through the registration form available on the website. The User will be responsible for maintaining the confidentiality of the data and information provided and for restricting access to their computer and access codes to prevent possible unauthorized uses.

If the User has reason to believe that their data has been disclosed to a third party, or if it has been used in an unauthorized manner, or is likely to be, they must report this situation to Siempre

Original immediately.

The User must verify that their data is correct and complete and inform Siempre Original when there is any variation and/or modification in the information provided during the purchase process.

4) Orders and Sales Conditions

The services and products offered through the website are intended for users to purchase clothing and accessories.

To place an order, the User must be over 16 years of age or have the consent of their legal guardians.

Orders will be shipped from the website to anywhere in SPAIN.

To place orders through the website, the User must provide a series of data prior to contracting, through the purchase form, which will be necessary to manage their purchase order.

4.1 Prohibited Use

You may not use our products for any illegal or unauthorized purpose, nor may you, in using the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in the immediate termination of your Services.

4.3 Purchase Conditions

Price

All prices displayed on the website are final prices, with Value Added Tax (VAT) expressly included.

Payment Method

When placing an order, the customer can freely choose to pay for their purchases 100% securely using Card (MasterCard, Visa, Visa Electron,...); Paypal (through its own platform) or through the digital wallets Apple Pay or Google Pay.

Siempre Original uses SSL (Secure Socket Layer) technology to protect all customer information during the online ordering process. SSL is the industry standard for online transaction security, sending all information in encrypted code.

Shipping Method, Timeframe, and Costs

Siempre Original guarantees to work with TIPSA, Correos and Correos Express, leading shipping companies in Spain and Portugal, to offer the best possible shipping experience.

Under normal conditions, you usually receive your order at home within 4-7 business days (Monday to Friday, excluding holidays).

Occasionally, depending on our production load, time of year (Black Friday, Christmas, Sales), sales area or region (Canary and Balearic Islands)... it may take a little longer, but this is not typical.

CHRISTMAS PERIOD:

  • Place your order before DECEMBER 8th to receive it before CHRISTMAS.
  • Place your order before DECEMBER 20th to receive it before EPIPHANY.

For orders placed after the deadline, we cannot guarantee timely delivery.

These deadlines exist because during peak season, shipping delays, large order volumes, and slower delivery times are common.

Shipping costs:

  • FREE. No surprises.

5) Exchanges and Returns, Legal Guarantee

Siempre Original offers a guarantee of

60 CALENDAR DAYS TO MAKE AN EXCHANGE OR RETURN

However, for the garment to be returned, it must be in perfect condition, not washed, worn, or stained.

5.1 Exchanges and Returns

The customer must send an email to info@siempreoriginal.com indicating the order number, the item they wish to exchange and the change they want to make.

Example:

  • Order 000000
  • Item 000000 change to size M.

In the event that you do not wish to exchange the product and wish to request a refund, the purchase amount will be refunded using the same payment method used by the customer (credit/debit card or via Paypal).

Siempre Original will contact the customer as soon as possible indicating the steps to follow.

5.2 Legal Guarantee

Siempre Original is proud of the quality of its products. Therefore, all of them undergo a rigorous 3-step quality control before being shipped.

However, if a defective or mislabeled product passes quality control or is damaged during shipping, Siempre Original will be responsible and a new product will be delivered to the customer at no additional charge.

To resolve it as soon as possible, the customer must send an email to info@siempreoriginal.com within one week of delivery with photos of the damaged product, order number, and any other details about the order. Siempre Original will contact you with a solution as soon as possible.

5.3 Procedure

  • First, the customer must send the garment to Siempre Original's postal address to verify the condition of the merchandise. Once received, the new item will be sent in case of exchange, or a refund will be issued in case of return.
  • Shipping costs will be shared by the customer and the company; the return is at the customer's expense, and the return shipping is at the company's expense.
  • If it is a refund, Siempre Original will return the purchase money using the same payment method used by the customer. Refunds for amounts derived from the right of withdrawal will be made within 14 calendar days of receiving the product.

 

6) Intellectual and Industrial Property

Siempre Original creates each design in good faith and with the sole objective of pleasing all who wear it on their t-shirts, sweatshirts, or other products.

Some designs are based on or inspired by films, series, television, public figures, popular culture… made as Fan Art, with all our affection. Siempre Original does not intend to copy any distinctive sign or brand but to interpret it in our own way.

If you in any way believe that your intellectual and/or industrial property rights have been infringed, please notify info@siempreoriginal.com including the following information:

  • Identification of the copyright, trademark, or what has been infringed.
  • The full address (URL) of the products and/or designs in question.
  • Your name, address, phone, and email.
  • A statement where you declare in good faith that the material subject to the complaint infringes the law or your rights. Attach some proof that the material is registered by you with an official body.
  • A statement that all information provided is correct and truthful.

 

In the event that any design infringes intellectual and/or industrial property rights, Siempre Original will take measures to remove or disable the products.

If the notification does not comply with all the aforementioned written notice requirements, it may not be valid, and Siempre Original may disregard such incomplete or inaccurate notices without any liability.

Ownership of Siempre Original

Siempre Original owns all intellectual and industrial property rights of its website, as well as the elements contained therein (including, but not limited to: trademarks and logos, images, photographs, designs, texts, graphics, video, etc.), owned by Siempre Original or its licensors.

All content on the website is duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registries. Regardless of the purpose for which they were intended, total or partial reproduction, use, exploitation, distribution, and commercialization, always requires prior written authorization from Siempre Original. Any unauthorized use by Siempre Original will be considered a serious infringement of the author's intellectual or industrial property rights.

7) Rights of Siempre Original

7.1 Monitoring

Siempre Original reserves the right (without assuming the obligation) to monitor transactions and communications that occur on its website. If Siempre Original determines, in its sole discretion, that a user breaches or may breach any condition of the General Terms of Use or that such transaction or communication is inappropriate, Siempre Original may cancel or restrict access to that user or the questionable material, without further liability to the parties involved.

7.2 Service Modifications

Siempre Original reserves the right to modify the distribution, organization, and appearance of its website and the services it offers, and may change or suspend any aspect of its services and/or prices without prior notice and without any liability to any of the parties before the completion of the purchase process.

7.3 Contract Termination

Siempre Original, at its sole discretion and with or without notice, may:

  2. b) remove content deemed appropriate from www.siempreoriginal.com's servers and directories
  3. c) Prohibit the use of www.siempreoriginal.com services

9) Limitation of Liability

Siempre Original excludes any liability for damages of any kind that may be due to the lack of availability or continuity of the operation of www.siempreoriginal.com, as well as the misuse of the website and/or its contents.

10) Applicable Law and Competent Jurisdiction

The law applicable to this contract shall be Spanish Law. In the event of any conflict or discrepancy in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter, if applicable, will be those provided by the applicable legal regulations regarding competent jurisdiction.
