By visiting the website or using the services, the user accepts these Terms and Conditions.

User registration is not required to access the website. However, in order to contract any of the services offered by Siempre Original, User registration and acceptance of these conditions will be required before finalizing payment.

Through the website, Siempre Original offers Users clothing and accessories.

3) User data

In order to purchase the products offered, it will be necessary for the User to register via the registration form available on the website. The User shall be responsible for maintaining the confidentiality of the data and information provided and for restricting access to their computer and access passwords to prevent possible unauthorized use.

In the event that the User has reason to believe that their data has been disclosed to a third party, or if it has been used in an unauthorized manner, or is susceptible to being so, they must notify Siempre

The User must verify that their data is correct and complete and inform Siempre Original of any variation and/or modification to the information provided during the purchase process.

4) Orders and Sales Conditions

The services and products offered through the website are intended for the purchase of clothing and accessories by Users.

To place an order, the User must be over 16 years of age or have the consent of their legal guardians.

Orders will be shipped from the website to any part of SPAIN, EUROPE, THE UNITED STATES, AND MEXICO.

To place orders through the website, the User must provide a series of details prior to contracting, via the purchase form, which will be necessary to manage their purchase order.

4.1 Prohibited use

You may not use our products for any illegal or unauthorized purpose, nor may you, when using the Service, violate the laws of your jurisdiction (including but not limited to copyright laws).

You shall not transmit any worms or viruses or any code of a destructive nature.

Failure to comply with or violation of any of the Terms will result in the immediate termination of your Services.

4.3 Purchase conditions

Price

All prices displayed on the website are final prices, with the corresponding taxes expressly included.

Payment method

When placing an order, the customer can freely choose to pay for their purchases 100% securely via Card (MasterCard, Visa, Visa Electron, American Express...); Paypal (via its own platform) or via digital wallets Apple Pay or Google Pay.

Siempre Original uses SSL (Secure Socket Layer) technology to protect all customer information in the online ordering process. SSL is the industry standard for online transaction security, sending all information in an encrypted code.

Shipping method, time, and costs

At Siempre Original we ship to Spain, all of Europe, the United States, and Mexico.

To offer faster and more efficient delivery, we work with an international logistics partner specialized in print-on-demand. Each garment is made exclusively after the order is placed and is produced, whenever possible, at the production center closest to the destination country. This way, we manage to reduce delivery times, minimize travel, and ensure a high-quality finish.

Under normal conditions you will usually have the order at home in 4-7 business days (Monday to Friday, non-holidays).

Occasionally, depending on our production load, time of year (Black Friday, Christmas, Sales), sales area or region... it may take a little longer, but it is not the usual case.

CHRISTMAS PERIOD:

  • Place your order before DECEMBER 8th to receive your order before CHRISTMAS (December 25th).
  • Place your order before DECEMBER 20th to receive your order before THREE KINGS DAY (January 6th).

For orders placed after the deadline, we cannot guarantee they will arrive on time.

These deadlines exist because shipping delays, high order volume, and slower delivery times are common during the peak season.

Shipping costs:

  • FREE. No surprises.

5) Changes and returns, legal warranty

Siempre Original offers a warranty of

60 CALENDAR DAYS TO MAKE AN EXCHANGE OR RETURN

Of course, to return the garment, it must be in perfect condition, and it must not have been washed, worn, or stained.

5.1 Changes and returns

The customer must send an email to info@siempreoriginal.com indicating the order number, the item they wish to change, and the change they want to make.

Example:

  • Order 000000
  • Item 000000 change to size M.

In the event that you do not want a product exchange and wish to request a refund, the purchase amount will be reimbursed to the same payment method used by the customer (Credit/Debit card or via Paypal).

Siempre Original will contact the customer as soon as possible indicating the steps to follow.

5.2 Legal Warranty

Siempre Original is proud of the quality of its products. Therefore, all of them go through a rigorous 3-step quality control process before being shipped.

However, if a defective or mislabeled product passes quality control or is damaged during shipping, Siempre Original will take responsibility and a new product will be delivered to the customer at no additional cost.

To resolve this as soon as possible, the customer must send an email to info@siempreoriginal.com within one week from the delivery date with photos of the damaged product, order number, and any other details about the order. Siempre Original will contact you with a solution as soon as possible.

5.3 Procedure

  • First, the customer must send the garment to the postal address of Siempre Original to check the condition of the merchandise. Once received, a new one will be sent in case of an exchange or a refund will be issued in case of a return.
  • Shipping costs will be shared by the customer and the company; the return is paid for by the customer, and the return shipment is paid for by the company.
  • If it is a refund of the amount, Siempre Original will refund the purchase money to the same payment method used by the customer. The refund of amounts derived from the exercise of withdrawal will be made within the 14 calendar days following receipt of the product.

 

6) Intellectual and industrial property

Siempre Original creates each design in good faith and with the sole aim of pleasing all those who wear them on their t-shirts, sweatshirts, or other products.

Some designs are based on or inspired by movies, series, television, public figures, popular culture… made as Fan Art, with all our affection. Siempre Original does not intend to copy any distinctive sign or brand but rather to interpret it in our own way.

If you believe in any way that your intellectual and/or industrial property rights have been infringed, please notify info@siempreoriginal.com including the following information:

  • Identification of the copyright, trademark, or whatever has been infringed.
  • The full address (URL) of the products and/or designs in question.
  • Your name, address, telephone, and email.
  • A statement stating in good faith that the material subject to the complaint infringes the law or your rights. Attach proof that the material is registered to you with an official body.
  • A statement that all information provided is correct and truthful.

 

In the event that any design infringes some intellectual and/or industrial property rights, Siempre Original will take measures to remove or disable the products.

If the notification does not comply with all the aforementioned written notice requirements, it may not be valid and Siempre Original may ignore such incomplete or inaccurate notices without any liability of any kind.

Siempre Original owns all intellectual and industrial property rights of its website, as well as the elements contained therein (by way of example: brands and logos, images, photographs, designs, texts, graphics, video, etc.), owned by Siempre Original or its licensors.

All contents of the website are duly protected by intellectual and industrial property regulations, as well as registered in the corresponding public registries. Regardless of the purpose for which they were intended, total or partial reproduction, use, exploitation, distribution, and commercialization requires, in any case, prior written authorization from Siempre Original. Any use not previously authorized by Siempre Original will be considered a serious breach of the author's intellectual or industrial property rights.

7) Rights of Siempre Original

7.1 Monitoring

Siempre Original reserves the right (without assuming the obligation) to monitor transactions and communications that take place on its website. If Siempre Original determines, in its own judgment, that a user breaches or may breach any condition of the General Conditions of Use or that said transaction or communication is inappropriate, Siempre Original may cancel or restrict access to said user or the questionable material, without further liabilities to the parties involved.

7.2 Modifications to the service

Siempre Original reserves the right to modify the distribution, organization, and appearance of its website and the services it offers, and may change or suspend any aspect of its services and/or prices without prior notice and without any liability to any party before the completion of the purchase process.

7.3 Cancellation of the contract

Siempre Original, at its own discretion and with or without notice, may:

10) Applicable law and competent jurisdiction

The law applicable to this contract shall be Spanish Law. In the event that any conflict or discrepancy arises in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter will be those provided for by the applicable legal regulations regarding competent jurisdiction.
